Terms and Conditions / Shipping

1. Scope of Application

  1. These General Terms and Conditions apply, in the version valid at the time the contract is concluded, to all business relationships between vdf Hochschulverlag AG (hereinafter referred to as “vdf”) and its customers.
  2. These General Terms and Conditions apply exclusively. Any conflicting or deviating terms and conditions of the customer shall not be recognized unless vdf has expressly agreed to them in writing in individual cases.

2. Conclusion of Contract

  1. The presentation of the vdf product range on internet-accessible systems does not constitute a binding offer to conclude a purchase agreement with the customer. It is non-binding.
  2. By placing an order with vdf via internet, email, telephone, fax, or other means of communication, the customer submits an offer to conclude a purchase agreement. The customer receives a confirmation of receipt of the order (order receipt confirmation). This confirmation does not constitute acceptance of the offer, but merely informs the customer that the order has been received by vdf.
  3. A contract is concluded when vdf accepts the offer by arranging shipment of the ordered product to the customer. For deliveries within Switzerland (or Liechtenstein), vdf is the contractual partner. For deliveries outside Switzerland, the contractual partner is Brockhaus Kommissionsgeschäft GmbH (hereinafter referred to as “Brockhaus”), which delivers in its own name and for its own account.
  4. Acceptance is subject to legal admissibility and availability of the ordered goods or services.
  5. Price fluctuations for items not subject to fixed pricing are possible.

3. Delivery, Shipping Costs for End Customers

  1. vdf will arrange for the ordered goods to be delivered as quickly as possible to the address specified by the customer in the order. Partial deliveries and partial services are permitted at any time, provided they are reasonable for the customer.
  2. Delivery shall be made at the shipping costs indicated in each individual case.
  3. Delivery time within Switzerland is usually 2–4 working days. For orders outside Switzerland, Brockhaus delivers from Germany in its own name and for its own account.

    Order value up to CHF 60.00:  CHF 5.00
    Germany: Free shipping for orders over € 50.00
    Order value up to € 50.00:     up to 2 kg:  € 5.00      up to 10 kg: € 7.00

    For shipments whose shipping costs are not listed in the table (especially shipments over 10 kg within Europe and overseas), please contact us at (verlag@vdf.ch).
    Depending on destination and weight, additional customs charges may apply (see section 7, point 1).

4. Retention of Title, Withdrawal from Contract

  1. vdf or Brockhaus retains ownership of the goods until all payments arising from the purchase agreement have been received in full.
  2. If the customer breaches the contract, especially in the event of payment default, vdf or Brockhaus may withdraw from the contract after setting a reasonable grace period.
  3. vdf or Brockhaus reserves the right not to enter into a contract in the event of a negative credit check result.

5. Due Date and Payment

  1. vdf or Brockhaus accepts only the payment methods displayed to the customer during the ordering process.
  2. The purchase price and any shipping costs incurred become due upon conclusion of the contract.
  3. vdf or Brockhaus may require advance payment without stating reasons.
  4. If a customer with a delivery address in Switzerland (or Liechtenstein) defaults on payment, vdf is entitled to charge a reminder fee of CHF 10.

6. Right of Withdrawal

  1. The customer is entitled to revoke their declaration of intent to conclude the contract within 14 days of receipt of the goods without stating reasons.
  2. In the event of an effective withdrawal, both parties must return any services already received.
  3. The customer shall bear the costs and risks of returning the goods unless the delivered goods do not correspond to the ordered goods.
  4. vdf or Brockhaus reserves the right of retention until the goods have been returned in full.
  5. The right of withdrawal is excluded for contracts concerning eBooks, downloads, opened software, DVDs, CDs and similar products.

7. Customs Duties and VAT

  1. Import duties may apply for imports into countries outside Switzerland and the EU. These costs shall be borne by the customer.
  2. The stated sales prices include the statutory VAT of Switzerland or Germany.

8. Warranty and Liability

  1. If the delivered goods are defective at the time of transfer of risk, vdf or Brockhaus shall provide a replacement delivery where possible.
  2. The liability of vdf or Brockhaus for its own fault, as well as that of its employees, legal representatives and agents, is limited to intent.

9. Use of Electronic Content via Apps (Google Play Store, iTunes Store, Browser Version)

  1. All provided texts, documents, illustrations and images are protected by copyright.
  2. It is not permitted to reproduce or distribute content without prior written consent from vdf.
  3. Unauthorized copies on devices or media accessible to third parties are prohibited.
  4. Access data such as email address, password and username are intended exclusively for personal use by the customer.
  5. vdf assumes no liability for external links outside its sphere of responsibility.
  6. Copyright and trademark rights remain fully reserved.

11. Final Provisions

  1. For deliveries to Switzerland and Liechtenstein, the provisions of substantive Swiss law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. If the customer is a merchant, Zurich shall be the exclusive place of jurisdiction for all claims arising from the business relationship.
  3. vdf reserves the right to amend these General Terms and Conditions at any time.
